Peter Chapman writes, “Treasury filed its brief this evening. Treasury also alerts Judge Alejandro that the Collins Plaintiffs have asked the High Court to review the Fifth Circuit’s decision.”

New filings in Wazee vs FHFA
Peter Chapman writes, “FHFA and Wazee Street delivered their briefs about the Fifth Circuit’s Collins decision to Judge Alejandro this afternoon. As we would expect, FHFA argues, under Dr. Calabria’s leadership, it’s structure is constitutional and invalidation of the Net Worth Sweep is inappropriate, and the Collins Plaintiffs agree with the majority that FHFA’s structure is unconstitutional and urge Judge Alejandro to side with the dissenting Fifth Circuit judges and order the Net Worth Sweep be vacated.

Peter Chapman writes, “The Collins Plaintiffs delivered their petition for review to the U.S. Supreme Court last week. The Collins Plaintiffs ask the High Court to review the constitutionality of FHFA’s structure and how much of HERA should or shouldn’t survive as a result. The Collins Plaintiffs recognize in footnote 1 appearing at pp. 5-7 of their petition it’s very unusual for a party prevailing in a Circuit Court of Appeals to take an appeal to the U.S. Supreme Court.”
