As we would expect, FHFA argues, under Dr. Calabria’s leadership, it’s structure is constitutional and invalidation of the Net Worth Sweep is inappropriate, and the Collins Plaintiffs agree with the majority that FHFA’s structure is unconstitutional and urge Judge Alejandro to side with the dissenting Fifth Circuit judges and order the Net Worth Sweep be vacated.
